I have been play poker for about 6 months now. I run into small house game tourny's on a weekly basis. There is another house game that has a good crowd about 4 nights a week. Also you can find some great tourny's and great action at a close by city about 50 minutes away.
My friend and I have come to the decision that we are going to have our own game on Mondays and Thursdays. We will have a tourny. that starts about 6:30pm and then we will have a 5/10 game and a no-limit table also.
We are about 2 weeks away from being open, we have just about all the supplies and are almost finished with his basement.
My question is; with the response that we have been getting, we are thinking that his basement will be too small a few months down the road, and were thinking about going to a retail or old factory location.
That game that I spoke of in the close by city is in a strip plaza.
They claim to be a fraternal club.
What are the risks and legalities?
Can someone help?

So you are talking about the Miamisburg game? I work at LexisNexis. I used to play there all of the time. There were some bad players in the games. I just wanted to play higher($10-$20). What are they spreading now?

I am pretty sure they are legal. Somothing to do with charity. They have an agreement with the city and everything.

LJH, doesn't Ohio have lottery tickets? what about bingo and such? Just to clarify your "no legalized gambling" comment.

C'mon, that's just silly. Pretty much every state in the union has lottery and bingo, but that's just not relevant. There is absolutely no question about it, a home poker game is 100% illegal. In states where gambling is legal, card rooms and casinos need to have a license to operate legally. Of course.

Im so with you on this. I can't figure out why people keep bringing up lottery, bingo, or regulated card rooms when making this argument. Those are all regulated and licensed, folks. If it ain't licensed, it ain't legal.

are you trying to say all home games are illegal?

what about California? They got away with card clubs 20 some years ago when it was determined that poker was a skill game and not gambling

We have a club in Northern Colorado. The rules are as follows:
not open to public (private club requiring membership)
No rake (run by dealers operating for tips)

California didn't "get away" with anything- card rooms are licensed, regulated and only allowed by law, just like in every other state that has cardrooms.

Home games, in most states are technically illegal. Some states have differences regarding the betting limit, whether the house keeps anything, etc., and will allow some games (for charities and otherwise) but in general, yes they are illegal because unregulated gambling is illegal. So keep your drapes closed :)
