Are home games and tournaments where there is no rake legal?

Please help. Just curious.

Hello Stevolley

The answer to your question depends on which state you live in.

Do a Google search for the gambling laws in your state.

Here in S.C. any table gambling is against the law including home poker games with your friends. I know of no instance where that is enforced however. It is so ridiculous that there is a statute in the S.C. code of laws that allows a person who lost in a gambling venture to SUE the winner for his losses! No joke.

In Texas it's legal if you comply with State Penal Code. We have it on our home game web site for our players to read. amarillopoker.org .

In most states, yes. I'm pretty sure that you can't have home games in Utah or Hawaii (though I could be wrong so if anybody knows for sure, correct me) and that you can everywhere else so long as there is no rake. In Canada, you can have a home game so long as there is no rake or entry fee that gets kept by the house and so long as you are not running hookers.

Generally speaking, nobody is concerned with friends getting together and having a friendly game. In most juristictions the law is concerned with somebody operating a parasitic brokerage in the form of a house of gambling that profits from the gamblers who frequent it.

First part is true (no gambling of any kind- only two States in the Union), second part is definately NOT true. However, you rarely hear of anyone getting their home raided (there was supposedly a club raid in Texas this summer)

In Texas you *definitely* can have a home game as long as there is no rake. That one I know for sure.
