Pokerroom Cashing Out, CMass, 3. Sep 2003 21:05

Here is my deal. About four weeks ago a friend of mine owed me $40 which I won playing a series of $5 heads-up NL hold'em with him (no laughing at the stakes, we want to play for fun and make it worth a little something to discourage bad play). So anyway, my bank doesn't allow me to charge money to online "gambling" sites, and I hate all the other options the sites give you (Netteller and so forth). So, I had him deposit $35 at Pokerroom.com into my account with his credit card and give me the other $5 in cash. But, pokerroom.com wouldn't allow him to deposit in my account with his credit card, so I had to create a new account under his name and have him put it in there. Anyway, over the course of 4 weeks, i turned the $35 into $1650 and at the same time changed banks to one that does allow depositing online (no, I didn't change banks just for this feature). So I made the decision to cash out, and then I would cash back in to my own account with $500 on my own credit card so that I wouldn't have to go through him every time I wanted to transfer money. When I tried to cash out, pokerroom.com put both my friends account, and my account under his name under investigation and temporarily halted payment on my cash out.

Now, before I had him deposit I read their user agreement carefully, and it states that no one person should have more than one account. However, it says nothing about 2 people using the same credit card account to deposit. Their signup never asks me my real name, only the name on the credit card I'm using. So as far as I can tell, I haven't broken any of their user agreement. I never represented myself as BEING him. So my question is first, do you believe that I've violated their user agreement? And, knowing the online poker industry, what will their action be from here on out? Essentially, theoretically if I did violate the user agreement, are they going to send me my check and then close my account, or are they going to freeze payment indefinently? Any guesses?

Under investigation just means that they are waiting for the credit card to clear. This comes up every now and then on the pokah forum. Don't worry, you'll get paid.

Just get signed letters from both him and you explaining the situation and I think they'll let you cash out. You've just accidentally set off their "anti-collusion" alarms. If they go over the history and see that these two player ID's have never been used at the same time, and same table, I think that they will give you the money, assuming that they are reasonable.
