As many of you may know their are many kids wondering around the poker rooms looking to make a dollar kids such as "Craig Tauterouff" smirk, grin. I ran into one a couple days ago and he kept insisting to me that Poker Stars is based in Costa Rica and he can go by their age limitations. I told him over and over again it goes by where you live not where the server is based we had a long arguement about it till it was finally his bedtime is this true. Or was I right.

Frankly, as it relates to internet poker, there is no current concrete law that covers it. However, I would argue that any state in which it is illegal to gamble on sports or games of chance could make a compelling case that it has jurisdiction over your PC and therefore COULD prosecute you. But, so far there is not the interest nor the law enforcement power out there to execute such a sting operation in any state, so I wouldn't worry about it. Also in my state (MA), the Governor is considering opening a casino in Boston to raise revenue...God love him!

Im referring to this kid being under age and he insist he only has to be the age of the cota rican law (doubtful if they have one ) but still he has to go by his state law not the costa rican law because hes connecting from his state not costarica

Yep, but his state doesn't have a law about internet poker. It is an open question as to what juristiction you are in, though most opinions say that you are in the juristiction of wherever the server is that is generating the data, random numbers, etc.

I don't think his argument holds water. It's all about jurisdiction. State and Federal government has personal jurisdiction over him and he has to follow the laws of this country regardless of where the "server" is located.

He couldn't buy Cuban cigars from a company whose server was in another country where cuban cigars are legal and have them shipped to the US.

Interesting question...Where is the actual action legally taking place? On the server (in Costa RIca) or on your client (PC in IL, MA, GA wherever)? If the program executes on the server (it does) then it should be no different than the laws in your state restricting you from gambling in LV (none). I think this is why there is a legislative debate occuring around the country. It does seem however, that the customs service may have some jurisdiction rather than the state....for anyone who travels abroad you'll remember that they restrict the amount of money one may carry across the border (10K I think?...in EITHER direction).

Yes, but he's not importing contraband. There's no reason he couldn't go to Canada, smoke cuban cigars there until he was happy as a fly on shizzit, then head home. Likewise, there's nothing prohibiting a bare breasted woman in Ontario from walking up to the border and showing her goods to all the Americans across the line. She's exposing her tits in Canada where it is legal to do so - the fact that Americans are looking at it from America is irrelevant.

Since the action is taking place in a foreign country it would be hard to make a case that the US had juristiction on the poker thing...and even then it is the sort of thing that nobody would bother to prosecute for until a clear and well defined law were to be passed.

Heheh...funny though...there was a big deal about it when the case that changed the laws was going though the courts, but there are never any bare breasted women walking around no matter how hot it gets. Hell, if men were allowed to walk around without pants, I'd be naked every day in the Summer.

There are no laws on the internet. If the casino is really based in America then it is unlicenced and it is illegal for anybody to play online there. Thus if you're underage and playing there it would make no difference how old you are. If it is based somewhere in the third world then you have 2 things going for you.
1) They don't care how old you are.
2) If they did and somehow wanted to charge you, there is no way on God's green earth that they could get you to set foot in their penny ante little nation to do it.

You're fine. Go nuts and try not to lose much, keh?

This whole question is invalid- it's like asking if it's illegal for someone under 21 to smoke pot in the US. It's illegal for everyone to smoke pot, age has nothing to do with it. If in fact online gambling is illegal (and our judicial system seems to strongly think so, even if they've been wrestling with the issue and not taking any action) then it makes no difference how old you are. It's completely a matter of each site's policy or the laws that THEY have to/choose to observe wherever they're based.

Yea! You have a pretty good point but I have a few arguments, I can make to that!

1. How many times has the judicial system changed the drinking law's I think it has went from 16 years of age to 21 in the state of New York that is.
2. How many people follow those laws. Do you realize how many underage kid's drink everyday.

So I'm going to have to agree with stdioh on this one he has a convincing argument. They will never be able to make a case and the poker room's dont care about your age because they never lose money just the players not the company.
