| Okay. So I did something stupid. Not stupid like go all-in with 72o, but worse. After having great success at rather steady home games amongst friends, after having read poker book after poker book, and after doing fairly well in various online poker rooms with fake money, I decided to go ahead and try to do real money online. I deposited 100 bucks and within a week of casual play, I doubled my money. The only problem is that I live in North Carolina. It never even occured to me to check on the legality of online gambling in North Carolina: I actually thought that I would be governed by the laws of where the online casino had its headquarters and not where I was connecting from. Well, I checked on it and it turns out that gambling online is illegal in North Carolina. It's a misdemeanor, and you could potentially face a fine or 6 months in jail for doing so. I'm not too worried about being locked up. I am kinda bummed though about my 200 dollars lying in limbo on the internet. If I try to cash out, will I not be allowed to? Anyone have any advice? I am 22, and a student, so I was thinking about potentially moving after graduation. Perhaps I can just keep my money online and cash out if I ever move to a legal state. Ferrum | ||

| I'm pretty sure it's illegal in just about every state, but the cops aren't going to bust down your door and drag you in for playing a little poker. I wouldn't be too worried unless a precedent pops up someplace else that would cause you to worry. Lee | ||

| The key there is that online "gambling" is illegal. Whether or not poker is considered "gambling" can change from state to state, but is still pretty much of a gray area. For the time being, I don't think any state is going after online poker players. This may change, but I wouldn't worry about it for now. | ||

| First, I AM NOT A LAWYER! The following post should not be construed as giving advice of any type, but merely presenting information as I know it to exist at this time. Direct EFT transactions are available at Neteller.com. Transactions are conducted between a merchant such as PartyPoker and Neteller, or between Neteller and a financial institution such as a bank. It appears that at no time is there a direct transaction between the merchant and the financial institution. Further reading at Neteller.com could provide further insight. | ||

| Just cash out and don't worry about it. Nobody has been prosecuted for onliine poker yet and if they decide to nail somebody for it, they won't pick on a kid who shoved in $100 and took out $200. If I were you I would keep playing for that matter. | ||

| To add an additional twist to this scenario, may I ask what type of internet connection are you playing on? If you are playing on a cable modem I don't think there has ever been a law written that outlaws poker or any form of gambling there. The law that the attorney general is using to say internet gambling is illegal was written in 1961 and specifically applies to telephone lines. Comments anyone? | ||

| I think the system will never be able to make a good enough case to ever prosecute anyone because there is so many people gambling online they cant prosecute everyone | ||

| As long as you don't deposit over $10,000 in a US Bank (above which, all such deposits are reported for mostly drug/other illegal activity), I see no reason that you will ever be caught. I view it the same as speeding...99% of the time, no ticket. | ||
