So is online poker legal or illegal?? Someone please let me know because I'm interested in signing up...

Also, are there ways of creating an account without a credit card?

As for creating an account, using neteller or firepay you can deposit money directly through your bank account (Some suggest firepay for depositing, neteller for cashing out, I cash out through neteller and it takes only a few days for it to show up in my account, have done about 10-12 cashouts and all went smoothly)

As for the legality, as of now it isnt being enforced at all in the U.S., as there are many laws on the books that arent enforced. However as I understand it , it is illegal (which doesn't stop me for a second for doing it)

is it legal? that is up for debate and i won't get into it as there are people on here more informed in this area than i am.

do you need a credit card? no. just sign up for neteller (www.neteller.com) or firepay (www.firepay.com). you can link them directly to your checking account and pay that way. some credit cards won't even approve on-line gaming charges anymore so these sites are the best way to fly......

The funny thing is it may be illegal in most states but that doesn't stop them from advertising on the Travel Channel.

Is it illegal by federal or state law?
This gambling is legal in California, they have B&M Card rooms.

Is it still illegal for California residents?

here is a good (albeit old) article from the washington post that sums up most of the points:

the general idea being that lawmakers think it is legal due to the wire act of '61. pro-gamblers say it is not illegal since phone wires are not technically used and the act does not explicitly mention the internet. poker players in particular would say that on-line poker is not illegal becasue it is not technically gambling as it is a game of skill.

Poker was declared a game of skill in California, back in 1913 or something(saw that on the Travel channel). So, I figure that online poker must be legal as well.

Only certain forms of poker were considered games of skill. Specifically, what was reffered to as " stud horse poker " was prohibited until the 1990s when stud and hold-em were legalized resulting in the famous " no fold-em hold-e m " era in California. The Senate Banking Comittee unanimously approved the Senate version of the internet gambling bill. However one key portion of the Senate bill would prohibit states from enabling Internet gambling within their state. This represents a violation of states rights to some and will provoke a lot of debate on the Senate floor. Is poker gambling? i don't think so but we'll have to wait and see. In the mean time, shuffle up and deal

Just because it's legal in B&M in California doesn't make online legal, or even a home game legal. The card rooms here are highly regulated, laws cover everything from the games they can offer to their very existence, and only a certain number are allowed. Think of it this way- if you lived in Nevada, would you be able to open up a casino in your basement without any government regulation? That essentially is what online casinos do, offer gambling without US regulation, they just can't be stopped because they're on foreign ground.

Besides that, federal law would supercede state law when it comes to online. Relax though, they won't bust people, they'll just keep getting on the banks and credit card companies (many of whom have already gotten out of the biz).

Is it legal? No. Is it illegal? No. Will you ever stand a chance of getting any flak at all from the law, IRS, or anybody else about it? No - as long as you pay your taxes. Sign up and don't worry about it.

And if you don't want to fund it with your card you can use netteller and fund it from your bank account. If you are concerned about anonymity, a lot of sites can take cashiers cheques, but you're going to need to give the site your name and address anyway, since they are going to have to know who to mail cheques to.

Also, when you do give a site your credit card information and pay via SFPay, the site itself doesn't process the card, the payment portal does that - so your credit card issuer doesn't even know that the money is going to poker. And the website storing your name is in the carribean and completely out of US control, so they couldn't get your information by any legal means.
