Does anyone have any comments about the legality of online poker? I know I may be too careful, but I just do not want to take any chance of breaking the law. I read most of the casual comments about how the law is not really that clear etc., but if someone could offer me some substantial reasons why there is nothing to be concerned about, I would REALLY APPRECIATE it! I love poker, but I live in a location where poker is NOT AVAILABLE. I really want to participate in the great online sites such as Planet Poker, Party Poker etc.

You're fine as long as you live somewhere in the FREE WORLD(TM) ... if you're American, Canadian, from a normal European country, Aussie, etc, then I don't think it's a problem to gamble online. If you're from China then there is probably the potential for trouble and if you live in a muslim country I'd be fairly certain that you can't gamble online.

.... on whether it is illegal or not. Check out Prof. I. Nelson Rose's "Gambling and the Law" website, as well as Badger's playwinningpoker.com, for some opinions.

Most of the opinions that I've seen, they don't seem to think that the Feds are storming down your door to get you. Those using the interstate wiring laws for their own political purposes are primarily after the sites themselves.

Thanks Easy,

I checked out the site you referred me to and learned a lot about the legality argument of online poker. Unfortunately, there seems to be nothing clear on the subject. I really hope the legislature would clarify this. Online poker is serious business, and I would like to participate without fear of retribution. It does not seem that this is an issue that will be resolved anytime soon.

Fear not, Bill. If you're in the USA, then you're not going to get in *ANY* trouble for this. If they finally make up their minds that it is definitely illegal, then there will be a big comeupance and you'll have to stop playing, but don't think that the American government is quite bad enough (though they are getting there fast) to go and arrest everybody who's been playing poker on the internet. In the worst case scenario, you'd probably hear on the news that it is being banned and you'd have to cash out and have nowhere to play.

Given the potential tax windfall for governments regulating online poker, it is not a question of "if", but "when" online is called into question. One site is santioned by an indian reserve in Canada but administered from the Dominican Republic, essentially to avoid the problems if indeed they set themselves up in "the free world". It is hilarious to consider that if I play for money on a train in Canada, I am breaking the law, but if I log on to a site (on the very same train) and play for money I am ok. It is only because the governments have not adapted to the worldwideweb yet. I hope they take their time. That said, you are ok playing if you are in the U.S. and Canada, Britain, etc.

When you play Partypoker, for example, you are giving instructions in the U.S. (for example) but the computer executing the card is in the Dominican Republic, so you are not gambling "in" the U.S. Therefore you are not gambling in an unregistered casino in your state. I have confidence in governments to find ways to tax virtually anything, so in time online will be regulated. Enjoy it while it is here, and declare your winnings ... ha ha ha.
